Tom, this is an unusual situation, if the loft is not mentioned in your lease I would suspect that it is owned by the freeholder and he would be perfectly within his rights to ask you for payment for this space.

It would be worthwhile obtaining the advice of a surveyor to establish a valuation of this space.
